The Elephant in the Room (01-15-06)

Play by Play Synopsis:

Teaser: In the inn.  Jordan and Woody wake up and start talking about a case Woody has to testify in.  Woody stops, pauses and then says maybe we shouldn’t we be talking about ‘this’.  Maybe we should be talking about last night, what it means, what we did….  Jordan says she has a problem she’s got to deal with.  Woody asks what she’s going to tell him.  Jordan says she doesn’t know.

In Rene’s apartment.  Woody talking with Rene and Garret, going over case, Rene is preparing him for trial tomorrow.    Garret and Rene talking after Woody leaves.  Rene says her case is Garret and based off of his testimony. 

THE CASE: A young wealthy man is on trail for killing a young girl.  They supposedly rented a room in a nice hotel for the night.  And when the girl decided she didn’t want to sleep with the boy, he killed her in a fit of rage.

Jordan and Nigel talking.  Nigel asks about JD.  Jordan avoids topic, says she needs sleep in her own bed first.  Woody comes in morgue with evidence that’s just been found.  Jordan gives Nigel the evidence says you’ve got 13 hours to come up with something.

Woody, in elevator asks Jordan: You coming?  She says no and starts to make a call on her cell phone.  Jordan is calling Garret, and Garret tells her he can’t talk.  He’s really got to, he’s in his car.  Then a cop walks up and asks Dr. Macy if he’s been drinking.

Act One: Jordan comes in, talking with Emy.  The place is going crazy.  Jordan is trying to get hold of Garret.  He still hasn’t shown up.

Garret and Rene at jail.  Garret says I’ll fight the charges. Rene says: thank you there will be no charges because of her.  Pulled some strings. Garret says he had half a bottle of wine.  Rene says point one two is more than half a bottle…Macy’s phone keeps ringing.  Rene tells him he’s got two hours to go clean up and be in court.

Nigel and Woody talking about the evidence he just brought Nigel the other night.  Nigel says he has nothing, he needs more time to do more extensive research.

Seely trying to get out of service elevator.  Woody goes over to help open the doors and he sees what in the elevator and a surprise look comes over his face.

Lily and Bug talking in her office.  Jeffery shows up behind Bug, with coffee and muffin for Lily.  Lily thanks, and kisses him.  Bug isn’t not happy.

Suddenly a fin rolls by…Seely says of this is for you Bug.  Bug says I don’t think we need a fish autopsied…Seely shows bug arm inside the sharks mouth.  Bug gets to work on the shark.

Court: Rene is questioning Garret on the witness stand.

Morgue: Lily is trying to get Jordan to sign something Jordan won’t says Macy will be back, then JD shows up.

Nigel and Lily are spying on them, Nigel tells Lily JD has ring for Jordan.

Jordan insists she can’t have lunch with JD.  JD says there is always time, then they walk in on the shark, he says he’ll catch up with her later.

Bug is cutting open shark and pulls out an arm.  Bracelet on arm.    Jeffery walks in and can’t stand the smell.  Jeffery asks if she’s a Jane Doe…cause she had tattoos says she was probably a prostitute and junkie…no one to care about her.  Bug says she’s Jane Doe and won’t make assumptions.  Bug yells at Jeffery to go away when they continue to disagree on who the victim could be.

Seely comes in and ask what’s up.  Bug explains what he has found on arm, a bit testy.  Seely says: “Lily and Brandau huh? Figured if she went for a dork, she go for you.”

Bug runs a residue test per Seely’s request when the girls fingerprint shows up on an unsolved robbery and murder case.  Girl did fire a gun.

Court Room: Lawyer suggests a third party was involved in the case and that that third party killed the girl.  Garret says no evidence to support that theory.  Then the defense lawyer gets a note and starts asking about Macy’s DUI.  Rene calls side bar.  Judge tells him to let it go that it’s not relevant to this case.  

At morgue: Garret is bombarded by everyone.  Garret explodes and tells everyone to SHUT UP.  Jordan shoes them out.  Jordan tries talking to Garret, very reasonable, asking what’s wrong.  She says they were worried about him that’s why they want to know want to know what happened.  Garret tells her not her business.

Knock on door.  Jordan is subpoenaed.  Garret wants to know what Rene subpoenaed her for.  Jordan says she didn’t, the defense called her.

Act Two: Jordan and Rene are talking in Rene’s office.  Jordan wants to know why she’s being called.  Rene asks does Garret have a drinking problem?  Jordan eventually says…no he doesn’t after trying to avoid the topic.

Nigel comes in.  Rene tells him how to answer questions, goes over his testimony for tomorrow.

Morgue – Garret’s Office: Jordan comes in and asks Garret: Why is there an issue with his drinking.  She says she lied to Rene.  She can’t protect him.

Morgue Crypt: Bug is explaining where the body could possibly be (in the ocean), to Seely by analysis he’s made on the algae and other such biological stuff found on the arm.  He’s narrowed down the area, but still too large.  Seely is impressed, says Bug must have been working all night.  Seely says get some sleep to Bug then rushes off.  He has an idea where the body can be found.

Jordan comes into her apartment.  JD is on her couch.  JD says he has some info.  He came to share it with Jordan.  He tells her that Garret was arrested for DUI last night and he spent the night in jail.  Jordan’s upset.  JD says do you want to talk.  She says not about this.  He says about something else then.  She says later ok?  He gives her a kiss and then leaves.

Court: Nigel is testifying.  Nigel is getting torn apart, the lawyer is tearing Macy apart, through Nigel.

Morgue: Bug and Lily are talking.  Bug can’t identify her.  Says she’s a Jane Doe.  And Lily comments how they’re not just cadavers to him but people—the dead bodies.

Then Seely comes in and he has a body—stuffed in a trunk.

Court: Jordan on the stand.  Lawyer wants to know why Jordan called Garret, Judge shoots him down—says the question isn’t relevant.  Lawyer asks her if Garret has drinking problem.  She says give her to him as a dead body and she’ll inspect his liver and then answer.  So lawyer rephrases his question and asks if she’s ever seen Garret take a drink while on duty.  She says yes.  He won’t let Jordan explain herself.

Act Three: Garret and Jordan talk at the elevator to the court house.  Garret says don’t…he doesn’t want to discuss it.  Rene comes up – says great work, you’ve blown the case if this sticks—in reference to Garret and his drinking.  Jordan says she’ll go over all the evidence again.  Rene says what good will it do?  The jury will think they’re trying to cover their tracks.

Nigel and Jordan are going over the case again.  Jordan says great, everything Garret did checks out.  Nigel says there’s still the towel that Garret hasn’t touched.

Bug and Seely going over the shark case.  Jane Doe—Bug found a bullet in her.  The bullet matches the one she used to shot the man in the robbery with.

Break Room: Nigel and Woody are talking in break room.  Woody says ever wait for a woman to make up her mind?  It’s like watching paint dry.  Nigel lets it slip that JD is going to propose.  Woody: WHAT.  Nigel tries to slip by, he doesn’t say anything to Woody when he stops him.  Woody walks out with a sad face.

Nigel and Lily in the morgue going over the charmed bracelet.  Lily talks about her charmed bracelet and how she had an awful mascot of her school charm.  It gets bug thinking and he goes and checks out some of the charms and one matches a high school mascot.  They are able to identify the body as Lizzy.

Bug is talking with father.  Father says Lizzy was good girl, and then she got bad boyfriend and got into drugs.  Bug asks him to tell him about the boyfriend.

Nigel and Jordan talking going over evidence.  Jordan asks if she saw Woody earlier or imagining things?  And Nigel responds I’m never going to get my nose into other peoples business again.  Jordan looks up, “Where’d that come from?”  And then one of their machine beeps.  A test shows that sweat on the towel isn’t the defendants and that there was a third person in the room (not just the girl and the guy).

Precinct:  Seely and Bug have the boyfriend in the interrogation room.  Bug wants to go interrogate him to get justice for her.  And Seely says which ‘her’ are you talking about (Jane Doe, Lizzy or Lily).

Seely is questioning him but he won’t say anything.  Then he and Bug go out and have a ’set up’ argument where Seely leaves the door open so the witness can hear them.  They pretend they have more information on the boyfriend than they really have.  Seely goes back in, and the suspect says he’ll make a deal.

Woody and Jordan are at the morgue.  Woody’s helping Jordan rearrange furniture as the try to recreate the crime scene.  Jordan says she hasn’t talked with JD yet…Woody makes a comment about she hasn’t yet?  She needs too.  Jordan again wants to know what that means.

Woody and Jordan start re-enacting the crime scene.  They are playing at how maybe the scene went down, with the boy and girl starting to make out…then the girl stopping…

J.D. walks in. As Woody has her in his arms.  Jordan explains it’s a Cavanaugh tradition.  Jordan says he’s just in time cause they need a third person.  They determine that the mean and the desert were brought at separate times.  And that the staff member that brought the dessert up must have seen the body and the ‘boyfirend’ paid him off to keep him silent.

Nigel and Woody are trying to find the male employees that worked that night, to round them up for questions.  Jordan is heading back to the court room, to ‘try and save Macy’s ass’.  Woody asks what she’s going to do and Jordan says, ‘I’ve no idea’

Act Four: Jordan comes into court and tells Rene to stall.  She takes the stand again.  Jordan starts to go over the case in minute detail. 

Woody and Nigel going over the five employees in the hotel that worked that night.  To get a DNA sample.  One of the employees bolt and Woody takes off after him.

Back at court, Jordan says she does have new information. There was a third party present.  Rene calls for a recess, just then Woody comes in dragging the hotel employee with him.  The defendant gets a look of terror then defeat on his face.  He knows he’s going to lose.

Bug and Seely are going over the case and how it happened with Lizzy, to her parents.  Bug gives the parents back the girls charmed bracelet.  The Mom starts to cry.  They sit there unable to do anything more, but at least they were able to identify her for the parents.

Garret walks into office and Abby is in his office.

Jordan enters his office. And says Garret you have a drinking problem and you have to get some help.  Then Garret steps away to reveal daughter there.  Then Jordan continues anyway.  She says he needs to get help or she’s going to ask that he be removed from his post.  Jordan apologized to Abby that she had to hear that, then she leaves.

Bug comes into Lily’s office.  She is on the phone with Jeffery.  Bug hangs up the phone on her.  And then he declares his feeling for Lily.  He tells her that even though he said it was okay three years ago, he never really did stop loving her.  Lily asks why is he telling her now?  Bug says he’s sick of regretting a moment of fear and he’s learned it’s never too late to do the right thing.

Jordan arrives at apartment.  JD is sitting in the hall.  He won’t come in.  Jordan says I have to tell you something, and JD cuts in that she ‘slept with Woody.’  Jordan says you know?  He says yes.  He could tell—reading the body language between her and Woody he was able to put it together.  Jordan says it was a weird situation, but JD doesn’t want to know.  JD starts talking. He says: “I think I can slide past it, or at least I can try (pause) As long as it didn’t mean anything.”  Jordan can’t look at him and won’t respond…and the scene fades out in silence.
